Terms of service

The small print, plainly.

These terms govern the use of Everglow, a pet memorial garden. We have tried to write them in the same language the rest of the site uses: short, direct and without surprises.

1. Who we are and agreeing to these terms

Everglow (everglow.koumen.net) is a personal project, not a company. By browsing the garden, raising a memorial or buying anything, you agree to these terms. You must be at least 18 years old to raise a memorial or make a purchase. If you do not agree, please do not use the service. Questions: everglow@koumen.net.

2. What the service is

Everglow is a pet memorial garden for companion animals. You can create a pet memorial page with a name, years, story, a cover photograph and messages from visitors. If you pay for a stone, that memorial also stands as a 3D stone in a walk-through garden or on a shore, with a larger photo wall and more ways to keep a light on.

What you buy is digital content, displayed in your browser the moment the payment clears: a memorial page, and on a paid tier a 3D stone standing in the garden. Nothing is shipped, nothing is downloaded, and no personal service is performed for you. The garden is a website; the thing you are paying for is a place in it.

  • Free page — $0. One companion, one cover photograph, their story and every message friends leave. No stone in the garden.
  • Everlight — $29 a year. A standing stone for one year, ten photographs, one companion.
  • Keepsake — $79 once. The same stone kept for good, thirty photographs, and up to five companions from one browser.

The full, current list of what each tier includes is on the pricing page; if the page and these terms ever disagree, the pricing page governs what you are buying.

3. No accounts — keep your private link

There are no usernames or passwords. When you raise a memorial, this browser receives a private key and a link containing it; that key is the only proof of the right to edit that memorial. Anyone with the link can act as its keeper, so treat it as you would a house key. A separate, non-secret cookie simply counts how many memorials this browser has raised. Clearing browser data removes both; see the cookie policy. We cannot recover a lost key, though we will try to help if you write to us from the address used for reminders.

4. Prices, payment and what happens at the end of a year

Every price here is in US dollars and includes any tax that applies. The number on the pricing page is the number on the checkout page; nothing is added at the end. A stone and a candle are both one-off purchases, and nothing on this site is a subscription.

Payment is taken by Creem (creem.io), which acts as the merchant of record. That means Creem — not Everglow — is the seller named on your invoice and on your card statement, it calculates and remits any sales tax or VAT, and it runs the payment itself. We never see or store your card number. Creem’s own terms and privacy policy apply to the payment alongside these terms; where the two differ about how a payment is handled, Creem’s terms govern, because the payment is theirs to run.

A purchase counts only once Creem confirms it succeeded, and that confirmation is what unlocks the stone. If money leaves your account but the page says the payment did not go through, write to us: we will check it against Creem and put it right.

The yearly plan does not auto-renew. At the end of its year the stone rests: it stops standing in the garden, the flame goes out, and the memorial falls back to the free page. Nothing is deleted — the words, photographs and messages stay where they are. You can renew at any time, or buy the Keepsake plan and it never rests again. We send two reminder emails if you have left an address: one before the year ends and one just after. You can stop them in one click. Refunds are covered by the refund policy.

5. Candles and flowers

A candle, a bouquet, or the pair are sold separately for a fixed term (one month, six months, a year). Each purchase places one light or one bouquet at the stone and adds its days to whatever time is already there, so buying early never wastes a day. One stone holds at most six of each; past that, a purchase lengthens the light rather than adding another object. No flame is permanent. Anyone holding the link — the keeper or a visitor — may buy one. Refunds are covered by the refund policy.

6. Your content and its public nature

You keep ownership of the words and photographs you add. By publishing them you give us the non-exclusive right to store, display and adapt them (for example, reading the colours of a photograph to carve a small figure) for as long as the memorial exists, solely to run the garden. You confirm that you have the right to share them and that they do not infringe anyone else’s rights.

A memorial is public. Its name, story, photographs, whispers and any badge are visible to anyone with the link and may appear in search results. Do not post personal information about living people, contact details, or anything you would not want a stranger to read. Sealed letters are the exception: their text is not shown until the date you chose.

7. Acceptable use

Please do not use Everglow to:

  • post unlawful, hateful, harassing, defamatory, sexual or violent content, or content that exploits minors;
  • impersonate someone else, or raise a memorial about a living person or animal;
  • upload malware, scrape the garden or its index in bulk, probe the service for vulnerabilities, or script purchases and messages;
  • use the site to advertise, sell, or collect other people’s personal information.

We may edit or remove content, or restrict access, where it breaks these rules or is reported to us. If you believe a memorial infringes your rights or should come down, see the contact page; we aim to respond within 3 working days.

8. Availability, changes and closing

The garden is a work in progress. We may add, change or retire features, and we will give notice on the site before a change that removes something paid for. We do not guarantee uninterrupted access: the service is provided “as is”, without warranties of any kind, and our liability is limited to the amount you paid us in the twelve months before a claim, to the extent the law allows. Nothing here limits liability that cannot lawfully be limited.

If Everglow ever has to close, we will give everyone a way to export their memorials, photographs and words first. We will not delete a memorial simply because it has been quiet.

9. Governing law and contact

Everglow is a personal project, not a company, and these terms do not designate a specific court or jurisdiction. Nothing here affects the mandatory consumer protections of your own country. If a provision is unenforceable, the rest stays in force. If a dispute comes up, please write to us first — we will try to sort it out directly. Material changes will be dated at the top of this page.
